Order on Board 14/10/2025
1. With the consent of learned counsel for the parties, the matter is heard finally.
2. By way of the instant petition, the petitioner has prayed for the following reliefs:-
1. Call for entire records of the Revenue Case No. 20200606170002/04/A-13/19-20
pending adjudication before Respondent No.4; and/or
2. Expedite the proceedings of Revenue Case No.202506310600004/2024-25 pending before Respondent No.4; with directions to decide the said case in stipulated time, and/or
3. Any other relief in favour of the Petitioner, which this Hon’ble Court deems fit and appropriate in
facts and circumstances of the case.
3. The instant petition has been filed being aggrieved by the enormous delay
caused
in
deciding
the
Revenue
Case No.20200606170002/04/A-13/19-20 by the Tehsildar, Dabhara, District Sakti, C.G. as well as the non-consideration and non disposal of various applications filed by the petitioner.
4. The brief facts of the case are that the petitioner made an application before the Respondent No.4 regarding illegal construction and obstructions caused by Respondents No.5, 6 & 7 wherein an inspection report filed by the Halka Patwari, RI & Tehsildar. On 07/07/2020 Application was moved by the petitioner seeking interim
3 / 4 relief against illegal construction carried out by the petitioner. However, till date no application nor the revenue case has been decided by the Respondent No.4. Hence this petition.
5.
Learned counsel for the petitioner would contend that non adjudication of the said revenue case shows the malafide intention of Respondent No.4 who in connivance with Respondents No.5, 6 & 7 has not decide the case as well as the applications moved by the petitioner, therefore, Respondent No.4 may be directed to decide the case of the petitioner.
6. Learned State counsel submits that they are ready to decide the pending case of the petitioner.
7. I have heard learned counsel for the parties and perused the documents.
8. Looking to the grievance raised by the petitioner and looking to the fact that the case is pending before the concerned revenue authority since 06/06/2020, it is directed that the concerned revenue authority i.e. Respondent No.4 shall decide the revenue case bearing No.202006061700002/04/A-13/19-20 expeditiously as soon as possible in accordance with law by giving sufficient opportunity of hearing to the Respondent No.5. 6 & 7.
9. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authority shall proceed in accordance with law.
