This is the first bail application filed u/s 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who have been arrested in connection with Crime No.5/2023 registered at Police Station - Gourela, District – Gourela Pendra Marwahi (C.G.) for the offence punishable under Section 392,34 of IPC. 2. As per the prosecution case, on 03.01.2023 at about 3 pm, when complainant Shripal Kasher along with his younger brother Gheran Kasher and son-in-law Shyamlal Kasher was returning from Gourela to their village Gangpur on a motorcycle after withdrawing Rs.50,000 from Jila Sahkari Bank Gourela, the applicants are alleged to have robbed them of the said amount near Bandhamuda Barrier. On report being lodged in this regard by the complainant, applicant Rajkumar Singh Nat was arrested on 24.03.2025 and applicant Suraj Dwivedi was arrested on
17.09.2025. 3. Learned counsel appearing for the applicants submit that the applicants have been falsely implicated in this case as the FIR was registered against unknown persons, TIP has not been done and no seizure has been made from the applicants. They submit
3 that the main accused in this case is Bablu Nat who has already been granted bail by this Court vide order dated 13.09.2023 in MCRC No.6012/2023.
They further submit that applicant Rajkumar is in jail since 24.03.2025 and applicant Suraj Dwivedi is in jail since 17.09.2025 and there is no likelihood of the trial to be concluded at the earliest. Therefore, considering all these facts, the applicants may be released on bail. 4. Learned state counsel, on the other hand, opposing the bail applications submits that accused Rajkumar has two criminal antecedents under Section 379 of IPC and considering the nature of offence, the applicants do not deserve to be released on bail. 5. Heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the entire facts and circumstances of the case, particularly the facts that the main accused Bablu Nat has already been granted bail by this Court vide order dated 13.09.2023 in MCRC No.6012/2023, no seizure has been made from the applicants, no named FIR has been registered, no TIP of the applicants has been done and also considering the fact that applicant Rajkumar is in jail since 24.03.2025, applicant Suraj Dwivedi is in jail since 17.09.2025 and there is all possibility of the trial taking considerable time for its final conclusion, this Court is of the opinion that a case for grant of bail to the applicants has been made out. 7. Accordingly, both the applications for grant of bail are allowed. It is directed that the applicants Suraj Dwivedi and Rajkumar Singh
4 Nat @ Raju Nat shall be released on bail on their furnishing a personal bond in the sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the concerned trial Court. Both the applicants are directed to appear before the trial Court on each and every date to be given to them by the said Court till completion of the trial. 8.
