The criminal Appeal .filed against the order dated 25.11.2010 (Annexure A-l) passed in Sessions Trial No. 17/2010, passed by First Additional Sessions Judge, Manendragarh, Place- Baikunthpur, District- Korea (C.G.), whereby the appellants have been convicted under Section 323 ' of IPC and sentenQed to undergo R.l. for 06 months each and fine of Rs. 500/-, each. 2. Appellants and the legal representatives of the complainant are present in person before the Lok Adalat ahd their identity duly verified from their respective Adhar Cards. -——},

Learned counsel for the parties joiritly submits that the complainant- Nandlal died on 16.10.2024 and the death certificate of the complainant is annexed therein, which is issued by competent authority. 4. Legal heirs of the complainant submit that they have entered into the compromise with appellants voluntarily without any pressure and fear and they do not intend to prosecute the accused/appellants any further and both have prayed for permission of the Lok Adalat to compound the offence under Section 323 of IPC. 5. Learned counsel for the State also on verifying the facts submits that the State does not have any objection in case if the parties are permitted to compound the offence as the disputing parties have entered into compromise. 6. Thus, the parties have arrived at the compromise and the offence under Section 323 of IPC is compoundable under Section 320 of Cr.P.C., the compromise is allowed. The offence in question is permitted to be compounded. 7. Appellants/accused are acquitted of the charge levelled against them and the impugned judgmentof conviction and sentence dated 25.11.2010 is set aside. 8. Accordingly, criminal appeal is disposed of in the aforesaid terms.
