Pathak, AC to SC III ------ Order No.02 Dated- 28.02.2025 Heard the parties. This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of W.P. (Cr.) No. 86 of 2007 to its original file. Learned counsel for the petitioner submits that W.P. (Cr.) No. 86 of 2007 was dismissed for default of the petitioner. It is next submitted that due to mistake of the Advocate’s clerk, as the case could not be marked in the cause list hence, the counsel for the petitioner could not appear before this Court when the case was called out. It is further submitted that non-appearance of the counsel for the petitioner before this Court was neither deliberate nor intentional. It is next submitted that the petitioner has very good grounds to agitate in the said W.P. (Cr.) No. 86 of 2007 and unless W.P. (Cr.) No. 86 of 2007 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that W.P. (Cr.) No. 86 of 2007 be restored to its original file. Considering the aforesaid facts of the case and the submission of the learned counsel for the petitioner, W.P. (Cr.) No. 86 of 2007 is restored to its original file to the stage at which, it was before its dismissal. List W.P. (Cr.)
