...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an appropriate writ or order or direction more particularly a writ in the nature of a writ of Mandamus declaring the action of the Respondents in expansion and formation of CC approach road from Chinigepalli, Thippireddygaripalle Revenue Village to Jangavandlapalli pursuant to tender invited by Respondent No.4 vide tender dt.23-09-2022 through .Nadaka Baata. that is passing through the agricultural lands of the Petitioner and his mother herein situated in Sy.No. 1225 and Sy.No. 1217 of Thippireddygaripalle Revenue Village, Chinnagattigallu Mandal, Tirupati District without paying compensation to the Petitioner for the land that is affected due to the formation of said road and for the trees, standing crop and ancillary that may be affected resultant thereto as illegal, arbitrary and violative of Art.14, Art.19(1)g, Art.21 and Art.300A of the Constituion of India, unjstified, contrary to the estbalished principles of law and unsustainable and consequnetly direct the respondents to forbear from taking posession of aforesaid subject land of the Petitioner herein till entire compensation is paid due to the proposed action of formation of CC approach road from Chinigepalli, Thippireddygaripalle Revenue Village to Jangavandlapalli pursuant to tender invited by Respondent No.4 vide and pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to stay all further action of formation of CC approach road from Chinigepalli, Thippireddygaripalle Revenue Village to Jangavandlapalli pursuant to tender invited by Respondent No.4 vide tender dt.23-09-2022 and pass such IA NO: 2 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to vacate the interim order dated 06.01.2023 in W.P.No.818/2023 and dismiss the writ petition and pass Counsel for the Petitioner:

ORDER
This writ petition is filed to declare the action of the respondents in contemplating to lay road in the agricultural lands of the petitioner and his mother situated in Survey No.1225 and Survey No.1217 of Thippireddygaripalle Revenue Village, Chinnagattigallu mandal, Tirupathi District, without paying compensation. 2. On the last occasion learned Government Pleader for Revenue submitted that there is no proposal for laying CC road in the subject land. In response, learned counsel for the petitioner sought time to get instructions from the writ petitioner and hence this matter is listed today. 3. Today, there is no representation for the petitioner. In view of the submission made by the learned Government Pleader for Revenue that there is no proposal for laying CC road in the subject land and as there is no representation for the petitioner today, this court feels it appropriate to close the writ petition. 4. Accordingly, this writ petition is closed. If the petitioner feels that cause in this writ petition still survives, he can make appropriate application for restoration of the writ petition within a period of two (02) months.
