This is an application under Section 528 of BNSS preferred by the applicant for directing the learned court concerned to club the complaint cases bearing No. as (1) Complaint Case no. 16210 of 2022 summoning order dated 12.7.2023, (2) Complaint Case no. 16216 of 2022 summoning order dated 21.2.2024, (3) Complaint Case no. 16223 of 2022 summoning order dated 16.1.2024, (4) Complaint Case no. 16060 of 2022 summoning order dated 20.2.2024 (5) Complaint Case no. 16061 of 2022 summoning order dated 27.2.2024 (6) Complaint Case no. 16063 of 2022 summoning order dated 4.3.2024, whereby the summoned under section 138 N.I. Act with police Station Kotwali District Agra on several dates in the year 2023-2024 pending before him by giving benefit of the applicant under section 242, 243, 245, 246 of B.N.S.S. 2023 pending before the court of Chief Judicial Magistrate, Court No.4, Agra. 3. Learned counsel for O.P. No.2 has raised a preliminary objection that till the applicant has not filed any application for connecting the said cases to be tried together. He submits that applicant may approach the court below on filing an appropriate application as per the statute. 4. Considering the submissions so made across the Bar, the application stands disposed of granting liberty to the applicant to prefer appropriate proceeding for consolidation of the said cases. The court below shall decide the said application strictly in accordance with law within a period of two months. 5. Passing of the order may not be construed to be an expression on the merits.
