GP FOR REGISTRATION AND STAMPS (AP) The Court made the following: 3 THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.24571 of 2023 ORDER: This writ petition is filed declaring the action of respondent Nos.2 and 3 in entertaining the sale deeds submitted by the unofficial respondents pertaining to the land in Patta No.1857 in Survey No.575/2 of an extent of 0.50 cents out of Ac.1.77 cents situated at Y.Kota Revenue Village, Y.Kota Gram Panchayat, Obulavaripalli Mandal, Annamayya District (YSR Kadapa District), as illegal and arbitrary. 2. Heard the learned counsel for the petitioner; learned Assistant Government Pleader appearing for respondent Nos.1 to 3 and learned counsel appearing for respondent Nos.4 and 5. 3. On perusal of the prayer and also the averments made in the writ petition, it shows that already there is a suit i.e., O.S.No.137 of 2023 pending between the parties and no prohibitory orders were passed by the competent Civil Court and there is no provision under the Registration Act, 1908 that without having any prohibitory orders, the respondent authorities are not entitled to reject any sale deeds executed by any parties. 4 4. In view of the same, the Writ Petition is dismissed giving liberty to the petitioner to move an appropriate application before the competent Civil Court. There shall be no order as to costs.
