1. Petitioner renews his prayer for pre-arrest bail. It is contended investigation is complete and the principal accused has been released on bail.
2. We have considered the materials on record. Earlier prayer of pre-arrest bail was rejected on merits. Statement of the victim implicates the petitioner in the crime. Submission of charge-sheet is an aggravating and not a mitigating circumstance. Grant of bail to co-accused is also not relevant as the parameter for grant of pre- arrest bail is significantly different from that of regular bail. Hence, we are not inclined to grant anticipatory bail.
3. Officer-in-charge shall submit explanation why steps were not taken to apprehend the petitioner notwithstanding earlier rejection of pre-arrest bail. Report be filed within one (1) week.
4. The application for anticipatory bail is, thus, rejected.
