N SRIHARI (Standing Counsel for ZPP MPP and GRAM PANCHAYAT) The Court made the following: 5 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION.NO.23084 OF 2020 ORDER:- This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents deleted the names of the petitioners from the Gramapanchayat Voters List-2020 of Garimulla Kothavalasa Village, Amdalavalasa mandal, Srikakulam District as illegal, arbitrary and contrary to the Panchayat Raj Act, Rules made there under and also violation Article 19(1)(a) of the Constitution of India and consequently direct the respondents to allow the petitioners to exercise their right to franchise in the ensuring Elections of Panchayat Raj institutions of Garimella Kothavalasa, Amadalavalasa Assembly constituency and Mandal, Srikakulam District basing on the voters list published in the Assembly Election 2019 and to pass such other order or orders...” 2. Heard learned counsel for the petitioners and learned counsel for the respondents. 3. The case of the petitioners herein is that the respondents have deleted the names of the petitioners from the Gram Panchayat voters list 2020 in respect of Garimella Kothavalasa, Amadalavalasa Assembly constituency and Mandal, Srikakulam District. 4. When the matter is taken up for hearing, it is observed that pending the writ petition, the subject local body General elections were already completed in February, 2021 after having verification through BLO’s (Booth Level Officers) in compliance with the provisions of the Representation of the People Act, 1951 r/w provisions of Andhra Pradesh Panchayat Raj Act, 1994. In view of the completion 6 of local body elections in the year 2021, as mandated under the Representation of the People Act, 1951, the voters list should be revised thereafter as per the schedule of the Election Commission of India and accordingly the grievance of the petitioner also might have been addressed due to revision of voter list, pending writ petition. As such, no cause survives in the present writ petition. If there is any grievance, the petitioner is at liberty to proceed further after submission of required representation before the authority concerned for further action. 5. With the above observation, the writ petition is disposed of. However, if there is any grievance, the petitioners are at liberty to proceed further after submission of appropriate representation before the authority concerned for further action. There shall be no order as to costs.
