The present writ petition has been filed to quash the impugned F.I.R. dated 02.10.2024 registered as Case Crime No. 584 of 2024 under sections 137, 87 & 142 B.N.S., P.S.- Handia, District- Prayagraj. A further prayer has been made to direct the respondent no. 2 not to arrest the petitioner in pursuance to the aforesaid case. 3. Although initially this Court entertained the petition by calling for a counter affidavit failing which the Investigating Officer shall remain present in the Court, however, on perusal of the record, we find that the petition itself is not maintainable in view of judgement of Hon'ble Apex Court passed in S.L.P (Criminal) No. 762 of 2020 (Hukum Chand Garg and others vs. State of U.P. and others) decided on 7.2.2022. 4.
