1. The applicant has preferred this Fourth Bail Application under Section 483 of the BNSS, 2023 for grant of regular bail as she has been arrested in connection with Crime No.72/2024, registered at Police Station- Fasterpur, District-Mungeli, Chhattisgarh, for the offence punishable under Sections 103(1), 109(2), 191(2), 191(3), 190, 61(2)(a) of the BNS,

2 / 3 dismissed by this for want of prosecution vide order dated 17.01.2025. The second bail application bearing M.Cr.C. No.2594 of 2025 was rejected by this Court vide order dated 03.04.2025 on merits and the Third Bail Application bearing M.Cr.C. No.5588 of 2025 was also dismissed on merits vide order dated 17/07/2025.

The case of the prosecution in brief is that, a report was lodged by one Narendra Patle stating that on 25.08.2024 his elder brother Bhagbali Patle, Vakil Patle, Kaushal Patle, and sister-in-law Santoshi were standing in front of the house of his brother Makhan Patle in Gram- Gigtara. At the same time a scuffle broke out in his house and after hearing the noise of the same the complainant went there and saw that the accused persons namely Kejuram Patle, Toran Patle, Makhan, Rambali, Chitrekha, Rajini, Minakshi, Bhagbali Patle, Vakil Patle, Kaushal Patle, and Santoshi with club caused injury to them due to which they received severe injuries.
3. Further allegation of the prosecution is that thereafter accused Kejuram Patle drove his E-Series Tractor and crushed Bhagbali Patle, due to which he died on the spot. Vakil Patle, Kaushal Patle, and Santoshi were taken to the District Hospital-Mungeli where Doctors declared Vakil Patle dead. Based on the report given by the complainant police registered the case against the accused persons.

Learned counsel for the applicant would contend that the some of the material and eye witnesses have been examined before the trial Court and they have not supported the case of the prosecution. He would next
3 / 3 contend that the applicant is in jail since 25/08/2024 and final conclusion of the trial will take sufficient time, therefore, the applicant being a lady may kindly be enlarged on bail.

Per contra, learned counsel for the State opposes the bail application submitted by the applicant and would submit that the earlier bail applications of the applicant have been rejected on merits and there is no change of circumstances to allow this repeat bail application, therefore, the instant bail application may be rejected.
6. I have heard learned counsel for the parties at length, perused the case and other materials available on record with utmost circumspection.

Taking into consideration the facts and circumstances of the case and further considering the nature of offence, particularly to the fact that it is a double murder case which took place in the broad day light and further considering the fact that earlier the bail applications have been rejected by this Court on merits and there is no change of circumstances to entertain this repeat bail application.
