Sri Shivajee Srivastava, learned counsel has filed his Power on behalf of respondent Nos. 5 and 6 which is taken on record. Heard Sri Arjit Srivastava, learned counsel for the petitioners, Sri Shivajee Srivastava, learned counsel for the respondent Nos. 5 and 6, learned A.G.A. for the State and perused the record. Pursuant to the order dated 30.04.2025, petitioner No. 1 Archit (corpus), aged about 9 years and petitioner No. 2 Deepesh (corpus), aged about 7 years have been produced by respondent No. 5 (Tau of the corpus). Both the minor corpus have been interacted personally in the Chamber as to whether they are comfortable with respondent No. 5 (Tau of the corpus). While interaction, both the minor corpus were sensitive and vocal. They have expressed their desire to remain with respondent No. 5 Ram Brijesh @ Ramvresh, who takes care about their overall welfare. Though respondent No. 5 Ram Brijesh @ Ramvresh is a named accused in FIR bearing No. 0371 of 2024, under Section 103(1) B.N.S., 2023 but looking to the welfare of the minor corpus whose parents are no more and kids are inclined to stay along with him, let the corpus petitioner Nos. 1 and 2 remain with the custody of the respondent No. 5 Ram Brijesh @ Ramvresh, who shall ensure for their overall welfare and security of their property/assets, if any, inherited by the kids and should not be meddled by anyone until the two minor corpus attain the age of majority. However, the petitioner No. 3 Mahesh Yadav (maternal uncle of the corpus) is granted the visitation rights to meet both the corpus twice in a month i.e. on the second and fourth Saturday of every month at the venue fixed by the S.H.O., Police Station-Soron, District-Kasganj without any hindrance. At the time of visitation, only the two corpus, their sister and petitioner No. 3 Mahesh Yadav (maternal uncle of the corpus) shall remain present. The S.H.O., Police Station-Soron, District-Kasganj shall ensure the compliance of the aforesaid order maintaining safety and security. With the aforesaid direction, the petition is disposed of.
