THE PAY AND ACCOUNTS OFFICER, VIJAYAWADA, N.T.R DISTRICT. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the SRK, J WP No.5269 of 2024 2 High Court may be pleased to issue an appropriate Writ, Order or direction, more particularly one in the nature of Writ of Mandamus declaring the actions of the respondents herein more particularly the actions of the respondent herein in not releasing the Financial Assistance for the petitioner daughters educational purpose at Abroad under Videshi Vidya Deevana Scheme in Phase 1 for the year 2019 - 2020 despite having the petitioner daughters name in the provisional approved list for the benefit by the State Level Screening Committee as arbitrary, highly illegal, opposed to the doctrine of legitimate expectation, devoid the principles of Natural Justice, in violation of Article 14, 21 of the Constitution of India and consequently direct the respondents herein to release the financial assistance under the Videshi Vidya Deevana Scheme forthwith to mitigate the hardship of the petitioner herein. Chejarla Venkateswara Rao, SC For A.P.Kapu welfare and development Corp.LTD The Court made the following: SRK, J WP No.5269 of 2024 3 The Court made the following ORDER: This Writ Petition has been filed seeking to declare the action of respondents in not releasing the financial assistance for the petitioner’s daughter educational purpose at Abroad under “Videshi Vidya Deevana Scheme” in Phase I for the year 2019 - 2020, despite having the petitioner daughter’s name in the provisional approved list as illegal, arbitrary, violation of principles of natural justice and unconstitutional and consequently, direct the respondents to release aforesaid amount forthwith. 2. The petitioner got selected under the scheme of “Videshi Vidya Deevana” Overseas scholarship with Application ID No.OV2019122486 for studying Masters in Computer Science in State University of New York and also completed her studies. As per the enquiry of Vigilance and Enforcement Department, the petitioner’s daughter is eligible. Despite passage of more than four years, no amount has been released to the petitioner. Hence, he filed the present Writ Petition. 3. Counter came to be filed by the respondent No.2 admitting the fact that daughter of petitioner is eligible for sanctioned amount and amount would be released soon after release of budget from the Government. In view of the aforesaid facts and circumstances and as there is no dispute with regard to the fact that petitioner is eligible for sanctioned amount, the respondents are directed to release the said amount of Rs.10,00,000/- (Rupees ten lakhs only) to the daughter of petitioner, within a period of eight (8) weeks from the date of receipt of a copy of this order. 5. With the above direction, the Writ Petition is allowed. There shall be no order as to costs.
