Neutral Citation No. - 2025:AHC:62869 Court No. - 6 Case :- WRIT - A No. - 55590 of 2017 Petitioner :- Smt. Bhagwati Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Hans Pratap Singh,Mitesh Agrawal,Rajkumari Yadav Counsel for Respondent :- C.S.C.,Nand Kishore Singh Hon'ble Saurabh Shyam Shamshery,J. 1. Heard Sri Chandrajeet Yadav, Advocate holding brief of Ms. Rajkumari Yadav, learned counsel for petitioner and Ms. Rishu Mishra, learned counsel for B.S.A. Hamirpur. 2. Petitioner was appointed on post of instructor on contract basis. Her contract was not renewed by District Magistrate by impugned order dated 24.12.2014. 3. Learned counsel for petitioner has placed a new case that since District Basic Education Officer by way of a proposal dated 18.12.2014 has not granted approval for renewal and by impugned order dated 18.12.2014, the same was set aside, consequentially proposal of renewal is accepted. 4. The aforesaid submission is baseless on two grounds. (i) The order dated 18.12.2014 passed by B.S.A. is not on record otherwise also the District Magistrate in a very specific terms taking note of unsatisfactory service of petitioner has returned a finding that her contract cannot be renewed. (ii) Even for the sake of it, argument of petitioner is accepted, still no contrary inference could be drawn of the impugned order, wherein in a very specific terms on ground that petitioner's services were unsatisfactory, her renewal was rejected. 5. Accordingly, no case is made out to interfere with impugned order and this writ petition is accordingly, dismissed. Order Date :- 24.4.2025 P.
