ORDER:
1. Heard the submissions of the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State.
2. The petitioner was arraigned as A.4 in Crime No. 135 of 2025 of Tirupati East Police Station, Tirupati District, registered for the alleged offences under Sections 308(2), 118(1) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023, on the complaint of the 2”^^ respondent.
3. It is alleged in the complaint that the 2'^^ respondent was assaulted by unidentified individuals, resulting in grievous injuries, and after which the assailants fled the scene of the offence. Subsequently, the 2 respondent ascertained that the alleged unidentified individuals nd are residents of Korlagunta, identified as Azim and his associates Rudra, Babblu, Teja Royal, and three others.
4. The learned counsel for the petitioner submits that the petitioner not present at the alleged scene of offence and that the petitioner is in no way connected to the alleged incident.
5. The veracity of the allegations made in the complaint would come to light during the course of the investigation. At this juncture, this Court is not inclined to interfere with the investigation. However, the offences alleged against the petitioner would attract a punishment of less than years, the Station House Officer, Tirupati East Police Station was seven
CRLP. No.4769 of 2025 Tirupati District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita 2023, purpose of investigation in connection with Crime No. 135 of 2025. This order would not preciude the investigation officer from filing a charge sheet or finai report after insofar as the petitioner is concerned, for the completion of the investigation.
6. Accordingly, the criminal petition is disposed of.
7. Miscellaneous petitions, if any, pending in the criminal petition shall stand closed.
