1 / 2 105.wp3239.2025 IN THE HIGH COURT OF JUDICATURE AT BOMBAY NAGPUR BENCH : NAGPUR WRIT PETITION NO. 3239 OF 2025 KGN Caterers and Traders, Chandrapur Vs. Municipal Council, Chimur, Dist. Chandrapur and Ors. ---------------------------------------------------------------------------------------------- Office notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's Orders. or directions and Registrar's orders. ---------------------------------------------------------------------------------------------- Mr. Soumitra Paliwal, Advocate for petitioner. Mr. S.M. Ghodeswar, AGP for respondent No.5. CORAM : NITIN W. SAMBRE AND SACHIN S. DESHMUKH, JJ. DATE : 30.06.2025. Having considered the fact that there is no prayer for inclusion of the petitioner in the list of the qualified tenderers, even if the petition is allowed, the petitioner cannot be allotted work. 2. Apart from above, the petitioner, who is declared as technically disqualified in the month of March 2025, same is accepted by the petitioner. 3. Now merely because there is a consecutive numbering on the stamp papers, that by itself can not be read by drawing an inference that Prity 2 / 2 105.wp3239.2025 respondent Nos.2 and 3 were working in tandem in getting the tender process hijacked in their favour. 4. In such an eventuality, no case for causing interference in the extra-ordinary jurisdiction is made out. 5. The petition stands dismissed. No costs. (Sachin S. Deshmukh, J.) (Nitin W. Sambre, J.)
