Government of Uttar Pradesh and others (2013) 2 SCC 1 and pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the 4th respondent herein to register the report given by the petitioner dated 11.03.2023 as FIR, pending disposal of the Writ Petition before this Hon'ble Court. ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a Writ of Mandamus or any other appropriate writ, order or direction declaring the action of the 4th respondent in not registering the FIR basing on the report given by the petitioner dated 11-(n-7023 arbitrary, illegal and unconstitutional and against the provisions of the Code of Criminal Procedure and consequently direct the 4th respondent herein to register the FTR in terms of guidelines issued by the Supreme Court in Lalitha Kumari Vs. Government of Uttar Pradesh and others (2013) 2 SCC 1 and pass.…”
2. Heard Sri Seepani S Kumar, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Revenue appearing for the respondents.
3. When the matter is taken up for hearing, Sri V.Farook, learned Assistant Government Pleader for Home for the respondents, on written instructions, would submit that after filing the present writ petition, police have gone through the matter and not registered the case since, the subject matter is a purely civil in nature. Learned Assistant Government Pleader would further submit that the police have not received the complaint from the petitioner as alleged in the present writ petition.
4. The learned counsel for the petitioner(s) submitted that the Court may pass appropriate orders.
5. Recording the above said submission, this Writ Petition is disposed of. However, the petitioner is at liberty to work out his remedies before the appropriate forum according to law. There shall be no Order as to costs.
