He further held that this village is not an estate. Then, an amendment was brought to the Act in the year 1957. By 5 4^ virtue of the said amendment, estates affected by the 1936 amendments included in the definition of “estate.” Then, by virtue of the amendment Government notified the above said village as an inam estate. Therefore, the petitioners preferred an appeal vide A.S. No. 17/1964 before the District Judge-cum-Estate Abolition Tribunal, Chittoor, against the orders of the Settlement Officer. The said appeal was allowed and the orders of the Settlement Officer were set aside. Aggrieved by the order in the above said appeal, the State of Andhra Pradesh preferred Writ Petition No. 4127 of 1969 before this Court, which was allowed vide orders dated 07.09.1973. Against the said orders in W.P. No. 4127 of 1969, a writ appeal in W.A. No. 275 of 1974 was preferred by the claimants, which was dismissed vide orders. were the Subsequently, an SLP was preferred before the Hon’ble Supreme Court. While things stood thus, the petitioners filed a claim application on 16.07.1978 before the Settlement Officer for Pursuant to the said application, the Settlement Officer endorsement dated 04.12.1980, grant of Ryotwari pattas. gave a subject which was challenged by the petitioners/claimants by filing EAT No. 2/1981 before the District Judge- Estates (Abolition Tribunal), which cum- was allowed, setting aside the endorsement of the Assistant Settlement Officer dated 04.12.1980 directing the Assistant Settlement Officer to hold an enquiry to consider the applications of the petitioners, which was pending. Subsequently, the claim of the petitioners was dismissed. Aggrieved by the orders of the Settlement Officer, the petitioners preferred W.P. No. 9294 of 2012. This Court allowed and the writ petition by way of orders dated 01.06.2017, setting aside the order dated 31.03.2011 of the 2nd respondent therein and directing the 2nd respondent to consider the case of the petitioners for grant of Ryotwari patta. Aggrieved by the orders in W.P. No. 9294 of 2012, the State of Andhra Pradesh preferred an appeal in W.A. No. 1643 of 2017. The Hon'ble Division Bench dismissed the writ appeal, confirming the orders of the learned Single Judge. In pursuance of the orders passed by the Division Bench of this Court, the petitioners herein filed an application. The said application was dismissed by the 3rd respondent vide orders dated 31.03.2021. Aggrieved by the above said orders, the petitioners filed EATAS No. 4 of 2001 before the Principal District Judge-cum-Arbitration Tribunal, and the said appeal was allowed in part and the matter was remitted back to the 3rd respondent to decide the matter afresh by giving an opportunity to the petitioners to adduce evidence on their behalf. So far, no orders have been issued by the 3rd respondent. Hence, the writ petition. 3. The learned counsel for the petitioners submits that, despite specific directions issued by this Hon’ble Court in W.P. No. 9294 of 2012 and W.A. No. 1643 of 2017, the 3rd respondent has not issued Ryotwari Sections 13 and 15 of the A.P. (Andhra Area) Estates (Abolition Conversion into Ryotwari) Act, 1948, treating Padirikuppam Village estate. He further submits that an appropriate direction may be issued to the 3rd respondent to consider the case of the petitioners in accordance with law. pattas under and as an mam 7 4 On the other hand, the learned Assistant Government Pleader for Revenue appearing for the respondents furnished written instructions dated 06.11.2024, wherein it is stated that:- In this connection it is submitted that, Sri.Govindaswamy Naidu and others filed claim petition before the Joint Collector. Chittoor for granting of Settlement patta U/s 15(1) of E.A. Act 1948, for the lands in Sy. No. 6, 12 etc of Padirikuppam village of Varadaiahpalem Manda.l As per the orders of the Hon'ble High Court in W.P No 9294/2012, Dt:01.07.2017 and W.A.No. 1643/2017, Dt:16.12.2019, the then Joint Collector Cum Settlement Officer, Chittoor has declared the subject lands Government lands and rejected the claim of the petitioners vide SR No.4/15(1)/97, Dt:31.03.2021.Aggrived by the above orders, Sri.B.Munirathnama and 12 others filed appeal before the Estate Abolition Tribunal, Chittoor in EATAS No 4/2021, the same was remanded to the JC Cum SO, Tirupati vide EATAS No.4/2021, Dt: 13.10.2022. Having regard to the submissions made by the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue appearing for the respondents, on perusal of the material available on record, this court is of the considered view that, the writ petition is disposed of by directing the 3'"’ respondent to consider and dispose of the EATAS No.4 of 2021 preferred by the petitioners and pass appropriate orders in accordance with law within a period of six (06) months from the date of receipt of the copy of this order after providing an opportunity of hearing to the petitioners. 8 6.
