...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, order or direction more particularly one in the nature of mandamus declaring the action of the 3rd respondent who has orally directed the petitioner to hand over the possession and enjoyment by declaring the right, title and possession of the suit schedule property in O.S.No.238/2021 unilaterally in favour of my sister and inaction of the 3rd respondent in respect of the representation dated 09.11.2021 as illegal, arbitrary and violation Articles 14, 19, 21 and 300 A of the Constitution of India and against the principal of natural justice and to pass.
IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 3rd respondent not to call the petitioner and his wife to 3rd Respondent town police Station, Kondapuram Town and Mandal, Nellore District with regard to the civil dispute in between the petitioner and his sister and pass. ORDER:
This Writ Petition under Article 226 of the Constitution of India is filed by the Petitioner seeking the following relief:
“...to issue a Writ, order or direction more particularly one in the nature of mandamus declaring the action of the 3rd respondent who has orally
directed the petitioner to hand over the possession and enjoyment by declaring the right, title and possession of the suit schedule property in O.S.No.238/2021 unilaterally in favour of my sister and inaction of the 3rd respondent in respect of the representation dated 09.11.2021 as illegal, arbitrary and violation Articles 14, 19, 21 and 300 A of the Constitution of India and against the principal of natural justice and to pass ....”
Heard learned counsel for the Petitioner and learned Assistant Government Pleader for Home appearing for respondent State. Perused the material on record.
Learned Assistant Government Pleader for Home on written instructions would submit that there are civil disputes pending between the Petitioner and his sister and that respondent Police never interfered in the civil disputes between the parties and would submit that this Court may pass appropriate orders by disposing of this Writ Petition.
Learned counsel for the Petitioner would submit that recording the said submission, this Writ Petition may be disposed of.
In that view, this Writ Petition is disposed of. No order as to costs.
Pending applications, if any, shall stand closed.
