ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents 2 and 3 in not registering the crime on petitioner's complaints dt. 26-06-2023 submitted against the respondents 4 to 7, as illegal, irregular, irrational, amounts to non-discharge of legal obligation conferred on them under the provisions of Code of Criminal Procedure, 1973 and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents 2 and 3 to register the crime and prosecute the accused persons for appropriate offences under penal provisions of law and pass.…”
2. None represented for the petitioner(s).
3. When the matter is taken up for hearing, Sri V. Farooq, learned Assistant Government Pleader for Home appearing for the respondents, on written instructions, submits that a case in Crime No.425 of 2022 was registered for suspicious death under Section 174 Cr.P.C. on the file of Srikakulam Rural Police Station. After conducting due enquiry, action in the said case was dropped.
4. He further submits that thereafter the complainant submitted a representation to the Superintendent of Police. On that representation also, an enquiry was conducted and the allegations were found to be false. The
learned Assistant Government Pleader submits that the police have served a notice on the de facto complainant informing the same and have also filed a report before the concerned Court under Section 169 Cr.P.C.
4. Recording the above submissions, the Writ Petition is disposed of. However, the respondent-police is directed to file a report before the Executive Magistrate Court, in accordance with law, if not already filed. There shall be no order as to costs.
