Mishra, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the order dated 04.05.2020, whereby, the claim of the petitioner for compassionate appointment has been rejected. Petitioner has approached this Court after a lapse of four years and the explanation offered is that in the year 2020 there was impact of pandemic Covid-19 and hence the order could not be challenged and thereafter on 29.05.2024 the mother of the petitioner died. I do not find the explanation offered to be very satisfactory as after 2021 there was no impact of pandemic Covid-19, inasmuch as, the mother has died in the May 2024. No justification is there available for the petitioner for not approaching the court in the year 2022-23. Nothing has been stated in the petition as to whether the mother of the petitioner was suffering from such an ailment that she required 24x7 attendance by the petitioner. Hence, I consider the explanation offered to be very vague and to somehow cover up the delay and laches on his part. Besides the above, the father of the petitioner died in the year 2004,the family survived for all these years and even after facing the impact of pandemic Covid-19 and even four years have passed after the pandemic and yet petitioner could not seize an opportunity to file a petition before a court of law. The law is well settled that if a litigant is not vigilant enough to his rights in approaching a Court of law within a reasonable time for redressal of his grievance, such claims are liable to be rejected for delay and laches.
