This is the defendants' petition. This writ petition has been filed with the following prayer; "(i) kindly set aside the impugned order dated 04.03.2025 passed by District Judge, Sambhal at Chandausi in Civil Misc. Appeal No. 02 of 2025 (Phool Singh and another Vs. Pramod Kumar) (Annexure No.1 to the writ petition) and the Court below may be directed to fix a date for hearing on the stay vacation application filed in Civil Misc. Appeal No. 02 of 2025 (Phool Singh and another Vs. Pramod Kumar), and further the parties may be directed to maintain status-quo over the disputed property till then." 2. It is contended that in the suit instituted by plaintiff respondent an application for grant of temporary injunction was moved, which was allowed by the trial court, against which defendant petitioners had moved Civil Misc. Appeal No. 2 of 2025 in which notices were issued and date was fixed for hearing on the stay vacation application moved by plaintiff respondent. Petitioners are aggrieved by the order dated 4.3.2025 issuing notice to the plaintiff respondent. 3. As the respondent has already appeared before the court below and misc. appeal is pending consideration, the court concerned is directed to proceed with the Civil Misc. Appeal No. 2 of 2025 and make every endeavour to decide the same, in accordance with law, after hearing all affected parties, within a period of two months from the date of production of certified copy of this order before him. 4.
