This MCC has been filed for modification of order dated 28.08.2025 passed in WPC No. 4608 of 2025. 2. learned counsel for the applicant prays to modify the order dated 2 28.08.2025 passed in WPC No. 4608/2025 filed by the petitioner to the extent that a direction may be issued to the respondent authorities with respect to deciding the complaint of the petitioner which has been filed as Annexure P/6 and/or pass any other necessary orders in peculiar factual matrix of the case in order to do complete justice with the parties, and in favor of the applicant. 3. Learned State counsel raised no objection in this regard. 4. Heard learned counsels for the respective parties at length and perused the record with utmost circumspection. 5. Para 2 and 5 of the order dated 28.08.2025 passed by this Hon’ble Court in WPC No. 4608 of 2025 reads as under: “2. Learned counsel for the petitioner would submit that at this juncture he would confine his prayer to the extent that the Respondent no. 1 may be directed to decide the interim application for grant of stay (Annexure P/7) and application dated 18.07.2025 (annexure P/8). 5. Considering the limited prayer made by learned counsel for the petitioner, it is directed that the respondent authorities shall decide the application filed by the petitioner Annexure P/7 and P/8 in accordance with law after giving opportunity of hearing to Respondent no. 3 2.” 6. On due consideration and for the reasons mentioned therein I am inclined to allow the present MCC. Para 2 and 5 of the order dated 28.08.2025 in WPC No. 4608 of 2025 will now be read as under: “2. Learned counsel for the petitioner would submit that at this juncture he would confine his prayer to the extent that the Respondent no. 1 may be directed to decide the complaint dated 24.03.2025 (Annexure P/6) and application dated 18.07.2025 (annexure P/8).5. Considering the limited prayer made by learned counsel for the petitioner, it is directed that the respondent authorities shall decide the application filed by the petitioner Annexure P/6 and P/8 in accordance with law after giving opportunity of hearing to Respondent no. 2.” 7.
