The present petition under Article 227 of the Constitution of India has been filed with a prayer to set aside the effect and operation of orders dated 13.1.2025 passed by Additional District & Session Judge/Special Judge (S.C./S.T. Act) Maharajganj in Criminal Revision No. 170 of 2023 as well as order dated 31.10.2023 passed by Judicial Magistrate, Maharajganj in Criminal Case No. 4885 of 2023 (Ram Udit Yadav and another vs. State of U.P. and another) arising out of Case Crime No. 0085 of 2022 under Sections 498A, 323, 504, 506 IPC and ¾ of Dowry Prohibition Act, Police Station Chowk, District Maharajganj. It has been submitted by learned counsel for the petitioner that the application of the petitioner moved under Section 239 Cr.P.C. seeking discharge has been rejected without considering the material on record. Petitioner being the brother-in-law of the husband has been falsely implicated. He undertakes that he shall cooperate in the trial proceedings. Till the pendency of the trial proceeding, no coercive measures shall be taken against the petitioner. With the aforesaid observation, the writ petition stands disposed of.
