Appellant has filed this appeal under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short “Act of 1989”) for grant of bail, aggrieved by the order passed in Special Criminal Case (Atrocity) No. 44/2023 by learned Special Judge (SC/ST Act), Raigarh, Dist. Raigarh, C.G. rejecting the bail application filed under Section 483 of BNSS on 17.10.2025, as he has been arrested in connection with Crime No. 268/2023 registered at Police Station- Tamnar District Raigarh for offences under Section 302, 201, 102B, 34 of IPC and Section 3(2)(v), 3(1)(R)(S) of the Act of 1989. 2. After arguing for some time, learned counsel for appellant seeks permission of this Court to withdraw this appeal and would further submit that only four witnesses, who are police officials, are remaining to be examined before the Trial Court, however, as per his information they are PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 2 not turning up for their examination. Therefore, direction may be issued to learned Trial Court to expedite the trial. 3. On due consideration of the submission of learned counsel for appellant, this appeal is dismissed as withdrawn. However, taking into consideration submission made by learned counsel for appellant and also the date of arrest of appellant, learned Trial Court is directed to expedite the trial and to take all necessary steps and measures for causing presence of prosecution witnesses and to conclude the trial expeditiously.
