This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action the 3rd respondent not taking any action on the complaint dated 26.01.2021, 07.02.2021 and also 19.03.2021, is illegal, arbitrary and principles of natural justice consequently direct the respondents to register the case and investigate the same as per the directions of the Apex Court (Lalitha Kumari Vs. Government of Uttar Pradesh reported judgment in 2014 (2) SCC page 1.”

Sri Md.Farooq, learned Assistant Government Pleader for Home, on instructions, would submit that they have not registered any crime basing on the petitioner’s representation, since the disputes between the parties are purely civil in nature. 3. Sri C.Prakash, learned counsel for the petitioner would submit that their right and possession of the property is fortified by the judgment of this Court and also the trial Court. But the some third parties are interfering in their possession. 4. Considering the submissions made, the Writ Petition is
disposed of. However, the Petitioner is at liberty to work out his
4 remedies before appropriate forum in accordance with law. No
order as to costs. Interlocutory applications, if any, pending shall stand closed.
