ORAL ORDER
(PER: THE HON'BLE MR. JUSTICE V.SRISHANANDA)
1. Heard Sri.Vasant G. Holeyannavar, learned counsel for the petitioner and Smt. Girija S. Hiremath, learned High Court Government Pleader for respondent- State.
2. Petition under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (or short, ’the BNSS’) with following prayer:
“The petitioiner humbly prays before the Honb’le court be please to release the petitioner/accused on bail in Old-Hubballi police station Crime No.212/2024 i.e. Sessions case No.5007/2025 for the offence under section 109,118(1),121(1),132 of BNS of IPC and which is pending on the file of V Addl. District and Sessions Judge, Dharwad Sitting at Hubballi.”

Facts in a nutshell for disposal of the petition are as under: Suresh H. Yellur, filed a complaint with old Hubballi Police Station on 26.09.2024 which was registered in Crime No.212/2024 for the following offences 109, 118(1), 121(1), 132 of the Bharatiya Nyaya Sanhita (for short, ‘the BNS’).

Gist of the complaint averments would reveal that on 25.09.2024 at about 7:30 P.M., present petitioner with an intention to escape away from the criminal acts which has been committed by him and taken the police to the place where the incident has taken place and at that juncture, he tried to overpower the police namely Ningappa N. Lamani and held his uniform and assaulted him. When the head constable bearing buckle No.1811 tried to rescued the Ningappa N. Lamani, he pushed him and assaulted with stone and thereby, Police registered the case. Two of the police personnel have sustained only simple injury.
5. Taking note of the fact that the accused is in custody on and from 18.10.2024, learned counsel has sought for grant of bail.
6. Smt.Girija S. Hiremath, learned High Court Government Pleader for respondent-State opposes the bail grounds.
7. Taking note of the fact that the charge sheet is filed and accused is in custody on and from 18.10.2024 and

injured persons have sustained simple injuries, petitioner can been enlarged on bail.
8. Other apprehensions of the prosecution can be met with by imposing suitable and stringent conditions. Accordingly, the following order is passed.
ORDER i. The criminal petition is allowed. ii. The Petitioner shall be enlarged on bail on executing a personal bond in a sum of Rs.1,00,000/- [Rupees one lakhs only] with two sureties of which one surety is cash surety for the likesum to the satisfaction of the learned Trial Judge. iii. The petitioner shall not directly or indirectly tamper the prosecution evidence in any manner. iv. Petitioner shall not leave the jurisdiction of Dharwad District without prior permission. v. Petitioner shall attend the court regularly. vi. The petitioner shall not indulge in similar offences.

Violation of any of the above conditions, would entitle the prosecution to seek for cancellation of bail. Ordered accordingly.
