JUSTICE V.SRISHANANDA) 1. Heard Sri.Shashwath S. Hiremath, learned counsel for the petitioner and Smt.Girija s. Hiremath, learned High Court Government Pleader for respondent- State. 2. Petitioner is seeking anticipatory bail in respect of FIR No.64/2024 registered by the Railway Police, Bangalore City Railway Station. On 31.012.2024 which is now transferred to Keshavapur Police Station in FIR No.224/2024. 3. Gist of the complaint averments would reveal that the petitioner has played fraud by furnishing PNR numbers for release of emergency quota seats, on the pretext that those PNR numbers are at the request of the head office. 4. On verification, no such request was sent by the head office. Therefore, complaint came to be lodged. From the date of registration of the complaint on 31.12.2024, till - 3 - NC: 2025:KHC-D:7025 CRL.P No. 101307 of 2025 today the Police have not taken any action to apprehend the petitioner. It is also claimed by the petitioner that he is attending the duty and there is a threat of arrest at any given point of time. 5. Taking note of the same, directing the petitioner to join the investigation would meet the ends of justice. 6. Further, if the petitioner is directed to undergo limited period of custodial interrogation by furnishing the necessary details including the mobile telephone and a request made by the petitioner for release of emergency quota, would also facilitate the investigation process. 7. Accordingly, following order is passed. ORDER i. The criminal petition is allowed. ii. Petitioner is directed to join the investigation by appearing before the investigation officer on 09.05.2025 at 10.00 a.m. - 4 - NC: 2025:KHC-D:7025 CRL.P No. 101307 of 2025 iii. The Investigating Officer is at liberty to take the petitioner to custody and complete the custodial investigation if any, on the same day before 6.00 p.m. iv. The petitioner shall co-operate with the Investigating Agency in all aspects of the matter including furnishing mobile telephone number, mobile hand set, password and such other necessary details for the effective investigation. After the custodial interrogation, petitioner shall be enlarged on bail, by taking a bond in a sum of Rs.1,00,000/- (Rupees one lakh only) with two sureties for the likesum of which one surety must be cash surety. v. Petitioner shall attend the Court regularly. vi. Petitioner shall not directly or indirectly tamper the prosecution evidence in any manner. - 5 - NC: 2025:KHC-D:7025 CRL.P No. 101307 of 2025 Violation of any one of the conditions would entitle the prosecution to seek for cancellation of the bail.
