D2 Namburi Venkayya is father of D3 Namburi Narasayya .who are son and grand son respectively, of Namburi Chandramouli. My Father Namburi koteswarrao Succeeded The Estate Of My Grand Father Namburi Narasayya and in turn I succeeded the estate of my father Namburi koteswarrao . it is submitted that at the out set the village revenue officer (Namburi Venkateswarulu ).issued pattadar passbook and title deed in my name stating that got ac 31.75 cents in s n o. 44-3 a 3b 3c 3d ,but in fact i got 15.83 cents only . the reaming property belongs to VRO and others .while the matter stood thus one Saripudi Chalapati Rao and 18 others tried to interfere with my peaceful possession and enjoyment of my land and thus filed os 75/ 2005 on the file of 3th addl. District judge Guntur ,transferred to 8th addl. District judge Guntur 9b .1 further states that a commission was appointed in os 75/ 2005 to answer the points raised in the commission warrant of suit schedule land with the help of district surveyor, the commissioner filed his report stating that my land was covered by s no 40(now 40-2) ,and 46, therefore i was advised to with draw the suit with leave to file fresh suit .latter i approached the Tahsildhar ,Amravati (namely komatineni nasarayya )to issue pattadar pass book ,and title deed ,who demanded me to pay rs 5,00,000 ,but i refused to do so . Having no other alternative i was advised to approach lokayuktha vide complaint no 1103/2019/B2 in which the DT collector submitted the response to lokyuktha Stating that I possessed ac 15.83 cents covered by Sno 44-3 A,3B, 3C ,3 D . vide complaint no 9C . I further states that when we filed Os No 75/2005 3 BKM,J W.P.No.5542 of 2021 respondents 2and 3 used say that my land is covered by s no 40(now 40-2) ,and 46 but not in Sno 44-3 A,3B, 3C ,3 D . when i filed lokayukta case the respondents 2and 3 gave report to lokayukta that my land covered by Sno 44-3 A,3B, 3C ,3 D . therefore itis very clear that the revenue authorities playing dialectical tact’s to cause in continence to me . further add or it covered in SN. 40-2,and 46 ‘’in the prayer portion . in the interest of justice IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to grant leave to Respondent No.3 in the W.P.No.5542 of 2021 to file counter affidavit in the above writ petition and pass Counsel for the Petitioner: 1.
