Heard the parties.
The petitioner has been made accused in connection with Jharia P.S. Case No. 234 of 2021, for the offence registered under Section 395 of the Indian Penal Code and Section 412 of the Indian Penal Code has been added, pending in the court of learned Additional Chief Judicial Magistrate, Dhanbad.
It is alleged that on 16.10.2021, container loaded with 86 tires driven by informant got stranded near Belgachia. It further appears that subsequently co-accused Pankaj Paswan and others looted the loaded tires. Pankaj Paswan was arrested and, on his confession, three tires were found lying near the house of the co-accused Jiwan Das.
It was submitted that petitioner is not named in the F.I.R and he has not been put on T.I. Parade. It was further submitted that nothing incriminating has been recovered from his possession. It was finally submitted that several co-accused persons have been granted bail by this Court as well as by the Coordinate Bench of this Court.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Dhanbad, in connection with Jharia P.S. Case No. 234 of 2021.
