ORDER:
The present writ petition is filed declaring the inaction of the respondents in pursuance of endorsement dated 04.11.2025 of the 4th respondent in mutating the name of the 1st petitioner with respect to the land in Survey No.139-1 admeasuring an extent of Ac.3.52 cents in Puduru Village, Naidupeta Mandal, Tirupati District (erstwhile SPSR Nellore District), as illegal and arbitrary.
2. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing for the respondents.

Learned counsel for the petitioners has submitted that initially the 2nd petitioner name was mutated in revenue records and 2nd petitioner has transferred the property in favour of the 1st petitioner by way of a registered settlement deed and accordingly, he made an application for mutation of his name in revenue records. During the course, it came to the knowledge of the petitioners that some third party name was reflected in revenue records and pattadar pass books were also made in his favour.

Accordingly, the 1st petitioner made an application for inclusion of his name in revenue records and also grant of pattadar pass books. She has further submitted that based on the application, the 4th respondent- Tahsildar has conducted an enquiry and based on the enquiry and field verification, he stated that as per the registered settlement deed document bearing No.1589/2010 dated 26.05.2010 the 1st petitioner got the property from the 2nd petitioner and also they are in possession of the property. Despite the said fact, the respondents have not considered and not mutated the name of the 1st petitioner and further not cancelled the pattadar pass books in favour of the third party by granting pattadar pass books to the 1st petitioner. Hence, the present writ petition is filed for implementation of the endorsement dated 04.11.2025.
4. Reply to the said
contentions, learned Assistant Government Pleader appearing on behalf of the respondents, on instructions, has submitted that the 4th respondent has not the competent authority to cancel the pattadar pass books which are in favour of the third party. Hence, the 4th respondent has referred the matter to the higher authorities and according to their

instructions, he shall cancel the pattadar pass books by mutating the name of the 1st petitioner.

Considering the submissions made by both the learned counsel, instead of keeping the writ petition pending, the Writ Petition is disposed of directing the 4th respondent to consider the application of the 1st petitioner for mutation of his name in revenue records as per settlement deed dated 26.05.2010 based on the possession. As far as cancellation of pattadar pass books are concerned, let the 4th respondent may refer the matter to the Joint Collector, who was newly impleaded as respondent No.5, within a period of one month and based on the report, the 5th respondent-Joint Collector may take appropriate decision, if required, by issuing notices to all concerned and may pass appropriate orders within a period of two (2) months thereafter. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
