1. This petition has been filed by the petitioner assailing the order dated 23.07.2024 (Annexure P/1) issued by respondent No. 5 by which the BHUMIKA ANGARE Digitally signed by BHUMIKA ANGARE Date: 2025.09.17 10:43:35 +0530
2 respondents have recovered amount to tune of Rs. 1,55,070/- from the petitioner who is at verge of retirement on account of access payment from the month of July 2008 to December 2018 after six years.
2. The issue regarding recovery at the verge of retirement and recovery from pensionary benefit has already been considered by this Court in case of L.K. Ladiya Vs. State of Chhattisgarh and Others in WP(S) No. 6459 of 2018 decided on 13.04.2023.
3. In view of the above, the instant writ petition also deserves to be
disposed of in terms of the judgment passed by this Court in case of L.K. Ladiya (supra).
4. Accordingly, the writ petition stands disposed of.
5. However, the petitioner is at liberty to make representation before the concerned respondent authority within a period of one month from the date of receipt of copy of this order who in turn shall consider and decide the case of the petitioner on its own merits in terms of the order passed by this Court in case of L.K.
