The applicant has preferred the anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory Bail, apprehending his arrest in connection with Crime No. 27/2025, registered at Police Station – G.R.P. Bhilai District- Durg (C.G.) for the alleged commission of offence punishable under Sections 305(c), 3(5), 317(5), 336(3), 338 & 340(2) of BNS, 2023. As per the prosecution story the complainant namely Heena Dinesh Bhai Patel lodged written complaint on 04/04/2025 alleging that while she was travelling in Shivnath express train no. 18240 HA 1 (21-2A) class some anonymous person committed theft and stole her purse in which her ornaments like diamond set worth Rs. 35,00,000/- second set of diamond worth 25,00,000/- amounting to sum of Rs. 65,00,000/- including her mobile phone was in the purse. During the course of investigation one of the co-accused namely Shekhar Prasad Das was arrested from Orrisa, while the memorandum of the co-accused was being recorded, he took the name of the applicant who is the nephew of the co-accused and hence the applicant has been arrayed as an accused in the present case. 3. Learned State counsel submits that the present applicant, along with other co-accused persons, has committed the offence of theft therefore, he is not entitled to the grant of anticipatory bail in the present case. 4. I have heard learned counsel for the State and perused the case diary. 5.
Considering the nature and gravity of the offence and also considering the fact that the allegations that on 04.04.2025, valuable jewellery and other articles worth approximately 65,00,000/- were stolen from the ₹
complainant Hina Patel while travelling in Train No. 18240 Shivnath Express, further on the basis of the memorandum of the co-accused person a substantial portion of the stolen property was recovered from the applicant, and it has been stated that the jewellery was sold to the present applicant through co-accused Shekhar for ₹11 lakhs,
therefore, I am not inclined to grant anticipatory bail to the applicant. 3
6. Accordingly, the anticipatory bail application of the applicant – Rohit Barman, involved in Crime No. 27/2025, registered at Police Station – G.R.P. Bhilai District- Durg (C.G.) for the alleged commission of offence punishable under Sections 305(c), 3(5), 317(5), 336(3), 338 & 340(2) of BNS, 2023, is rejected.
