1. Mr. Saurabh Kumar Pandey, learned counsle for the applicant.
2. Mr. Siddhartha Bisht, learned A.G.A. with Mr. Himanshu Sain, learned Brief Holder for the State.

The present applicant ‘Malkeet Singh’ S/o Karnail Singh is languishing in jail since 05.02.2025 in relation to First Information Report dated 04.02.2025 bearing FIR No. 08 of 2024, wherein, the present applicant has been implicated for the offences punishable under Sections 2, 9, 39, 50 and 51 of the Wild Life (Protection) Act, 1972 (Uttarakhand Amendment) Act, 2022, P.S. Ramnagar, District Nainital.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and the false recovery has been shown from the present applicant and all the offences are triable by the Magistrate and punishable for less than three years.
5. On the other side, learned A.G.A. for the State have not disputed this fact that all the offences are triable by the Magistrate, however, they bring to the notice of this court that the applicant is also implicated earlier in relation to the similar offence.
6. Be that as it may, admittedly the offences as alleged are triable by Magistrate and punishable for less than three years and as such this court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed.
8. Let the applicant ‘Malkeet Singh’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
9. It is made clear that after being released on bail if the applicant is found to be indulged in any
2025:UHC:3443 such criminal activity the prosecution is free to move an application for cancellation of bail.
