Shetty, learned counsel for petitioner files a memo with a copy of the order passed in Crl.P.No.101484/2023 by the Coordinate Bench wherein accused No.1 has been enlarged on bail and present petitioner stands on the same footing that of the accused No.1. Therefore, on the ground of parity, petition needs to be allowed. 2. Learned High Court Government Pleader did not dispute the grant of bail to accused No.1 by the Coordinate Bench of this Court as referred to supra. 3. Hence, on the ground of parity, petitioner who is accused No.3 is entitled for an order of bail. 4. Accordingly, following order is passed. ORDER i. The criminal petition is allowed. - 3 - NC: 2025:KHC-D:7015 CRL.P No. 101559 of 2025 ii. Petitioner shall be enlarged on bail on executing a personal bond in a sum of Rs.1,00,000/- [Rupees one lakh only] with two sureties for the likesum to the satisfaction of the Trial Court. iii. Petitioner shall attend the Court regularly. iv. Petitioner shall not tamper the prosecution witnesses in any manner. v. Petitioner shall not indulge in similar offences. vi. Petitioner shall not leave the jurisdiction of Dharwad District without prior permission. Violation of any of the above conditions, would entitle the prosecution to seek for cancellation of bail.
