Vide order dated 15.12.2022 the present appeal was dismissed for non-prosecution. An application for restoration was filed however the said application was also not argued on a number of dates. Eventually on 08.02.2024 it was made clear that in case the application is not argued, the same would be dismissed for non-prosecution. Vide order dated 28.10.2024 the appeal was restored to its original number subject to payment of ₹5,000 (rupees five thousand) as costs and, on the request of the learned counsel for the appellant, the case was adjourned to today for arguments. 2. Though the costs have since been deposited however none has put in appearance on behalf of the appellant despite the matter being called twice since morning.
