This writ petition has been filed with the following prayer; "To direct the civil judge (Junior Division) Gunnaur Distrit Sambhal to decide the civil misc. case no. 03/2018 (Smt. Rajwati vs. Banwari and others) filed by the Plaintiff/Petitioner within the shortest reasonable period fixed by the Hon'ble court." 2. It is contended that the suit filed by plaintiff was dismissed for want of prosecution. An application under Order IX Rule 9 CPC was moved for recalling the dismissal order, which has been registered as Misc. Case No. 3 of 2018. The sole prayer made in writ petition for early disposal of the said misc. case. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondent, with a direction upon Civil Judge (Junior Division), Gunnaur, District Sambhal to decide the Civil Misc. Case No. 3 of 2018, in accordance with law, after hearing all affected parties, preferably within a period of four months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
