Chandragiri U.P.S Rep by its Public Prosecutor, High court of AP Amaravati Respondents/Defacto Complainant Petition under Section 482 of BNSS is filed praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to grant Anticipatory Bail to the petitioners/AI A2 and A3 relating to the FIR No!263/2025 dated 11-11-2025 in the event of their Arrest by the SHO, P.S. Chandragiri UPS. The petition/Appeal coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri A.SRINIVASA RAO Advocate for the Petitioner, PUBLIC PROSECUTOR (AP) for the Respondent and the Court made the following. ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.1, 2 & 3 for granting of pre-arrest bail in connection with FIR No.263 of 2025 of Chandragiri Urban Police Station, Tirupathi District, registered for the alleged offence punishable under Sections 105 ‘the BNSS’ and 115(2), 351(2), 61(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. The allegation against the Petitioner Nos.1 & 2 is that they not only beat the de-facto complainant but also beat the 2"^ daughter of the de-facto complainant Bukya Deekshitha Priya with their hands on her cheek. As a result, the one-year girl child lost consciousness after emitting blood from nose and mouth. There are specific overt acts against Petitioner Nos.1 2/Accused Nos.1 & 2.
Hence the request for grant of pre-arrest bail is not found convincing and permissible. of &
4. Hence, the Criminal Petition against Petitioner Nos.1 & 2 is dismissed. Petitioner Nos.1 & 2/Accused Nos.1 & 2 shall surrender before the Investigating Officer concerned within one (01) week from today. On such surrender the Investigating Officer may proceed in accordance with law. 5. In so far as the allegations against the Petitioner No.3/Accused No.3 is concerned, there are no specific overt acts against Petitioner No.3/Accused
3 No.3. It is alleged that Petitioner No.3 and the de-facto complainant had live-in relation. There are disputes between Petitioner No.3 and the de-facto complainant. Considering the facts and circumstances of the case, gravity and nature of the allegations levelled against Petitioner No.3/Accused No.3, this Court is inclined to grant pre-arrest bail to Petitioner No.3/Accused No.3. In the result, the Criminal Petition is partly allowed with the following
6. 7. conditions: In the event of arrest of Petitioner No.3/Accused No.3, he shall be enlarged on bail subject to she executing a self-bond for a sum of Rs. 10,000/- (Rupees Ten Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials. Petitioner No.3/Accused No.3 shall make himself available for investigation as and when required. Petitioner No.3/Accused No.3 shall not cause any threat, inducement or promise to the prosecution witnesses. Petitioner No.3/Accused No.3 shall surrender his passport, if any, to the investigating officer. If he claims that he does not have passport, he shall submit an affidavit to that effect to the Investigating Officer. i.
