ORAL ORDER (PER: THE HON'BLE MR. JUSTICE VENKATESH NAIK T)
Learned counsel for the petitioner has filed a memo for withdrawal of the criminal petition. Memo which is placed on record reads as under:
“The petitioner in the present case, humbly submits as follows. The petitioner herein has filed the present petition seeking to quash the complaint and FIR filed by the 1st respondent as regards the petitioner/Accused No.3 in crime no.32/2024 for offence p/u/sec.365 r/w 34 of IPC, pending on the file of the Judicial Magistrate First Class II Belagavi. It is submitted that the present petition was filed after the registration of FIR. That the chargesheet as against the said FIR No.32/2024, is filed by the Respondent No.1 on 22.03.2025. As the chargesheet is already filed by the Respondent No.1, the present petition seeking quashment becomes infructous.
In light of the above, it is humbly prayed before this Hon’ble Court to permit the petitioner to withdraw the present petition and grant liberty to file fresh petition. Hence, the present memo. The present memo may kindly be taken on record, in the interest of justice.”
