JUSTICE AHANTHEM BIMOL SINGH 19.06.2025 [1] Mrs. Th. Babita, learned counsel appeared for the petitioner; Mr. Shyam Sharma, learned GA appeared for the respondent nos. 1 to 4; and Mr. S. Suresh, learned counsel appeared for the respondent no. 5. [2] The present petition has been filed with a prayer for directing the respondents to sanction pension and other retiral benefit of late Thokchom Robindrokumar Singh alias @ Thokchom Robindro Singh, who was the husband of the present petitioner, with effect from 03.12.2009 on which date he was given compulsory retirement from service. It is also prayed on behalf of the petitioner that further direction be issued to the respondents to allow the present petitioner to enjoy family pension from the date when her husband expired i.e. 28.12.2018. [3] Mrs. Th. Babita, draws attention of this Court to a letter dated 26.07.2022 from the Inspector General of Police (Adm), for Director General of Police, Manipur Police Department, Imphal addressed to the LUCY GURU MAY UM Digitally signed by LUCY GURUMAYU M Date: 2025.06.19 17:09:12 +05'30' 2 Superintendent of police, Ukhrul district stating inter alia, that the husband of the petitioner was entitled to receive all the retiral benefit as well as pension on his compulsory retirement and also for payment of family pension to the petitioner and also requesting to submit a concrete proposal in the prescribe format along with relevant documents to the Police Head Quarter for initiating the pension process and obtaining concurrence of the Government. Referring to the said letter, the learned counsel submitted that as the authorities have given finding that the late husband of the petitioner was entitled to receive all the retiral benefit including pension and also on his death the petitioner is entitled to receive family pension and that the necessary process for payment of such retiral benefit and pension to the petitioner has already been initiated, the present writ petition may be disposed of by directing the respondent to expedite the process for payment of the retiral and pensionary benefit due payable to the husband of the petitioner and also the family pension due payable to the petitioner within a stipulated period. [4] Mr. [4] Mr. S. Suresh, learned counsel appearing for the office of the Accountant General submitted that respondent no. 5 is yet to receive any proposal or documents for releasing the pensionary and retiral benefit due payable to the husband of the petitioner as well as to the petitioner and that as and when such proposal is received from the concerned 3 official of the government, appropriate action will be taken up by respondent no. 5 [5] On the other hand, Mr. Shyam Sharma, learned GA appearing for the respondent nos. 1 to 4 submitted that he have received certain instructions from the Superintendent of Police, Ukhrul district that necessary process are being taken up and to seek some time for completing such process for payment of the retiral and pensionary benefit due payable to the petitioner and as well as family pension to the petitioner. The learned GA further submitted that he has also received instruction that the SP, Ukhrul has requested the petitioner to furnish some necessary documents which are in her custody and also for her personal appearance in connection with preparation of the concrete proposal for payment of pensionary and other retiral benefits due payable to her deceased husband and that the cooperation of the petitioner is required to expedite the process. [6] The learned GA, fairly submitted that the present petition may be disposed of by directing the authorities to complete the process for payment of pensionary and other retiral benefit due payable to the deceased husband of the petitioner and also family pension to the petitioner within a reasonable period and also by directing the petitioner to extend full cooperation to the authorities with regard to the preparation of the necessary proposal for availing pension and other retiral benefit. 4 [7] Taking into consideration the submission advanced by the learned counsel appearing for the parties, this Court is of the consider view that the it will be in the interests of justice to disposed of the present writ petition by issuing the following direction; 1. The respondent nos. 1 to 4 are directed to expedite the process for submitting a concrete proposal for payment of pensionary and other retiral benefit due payable to the petitioner as provided under law as early as possible but not later than six months from today. 2. The petitioner is directed to extend full cooperation to the concern authorities of the government as and when she is required to do so and also to furnish all the necessary documents which are in her custody to the concern authorities as early as possible. 3. The respondent no. 5 is further directed to complete the process for issuing pension payment order within a period of two months from the date the respondent no. 5 receive concrete proposal from the concern authorities of the State Govt.
