This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.81/2025 registered at Police Station, Kabir Nagar, Raipur (C.G.) for the offence punishable under Sections 118(1), 296, 351(2) of Bhartiya Nyay Sanhita, 2023. 2. 2 09:15 p.m., the complainant Gendlal Dhruw, after having dinner, was walking on the terrace when he heard sounds of an argument. Upon coming down to the fourth floor, he allegedly saw the present applicant, who is his neighbor, abusing his own wife over some old disputes. When the complainant questioned him about the abuse, the applicant allegedly hurled filthy abuses at the complainant, threatened to kill him, and assaulted him with a knife he was carrying, causing injuries to the complainant. 3. Learned counsel for the applicant submits that this is the second bail application of the applicant and the first bail application was rejected by this Court on merits vide order dated 24/07/2025 in MCRC No.4878/2025. He would submit that the applicant is innocent and he has been falsely implicated in this case and the applicant and complainant are well known to each other and they are neighbours, therefore there is every possibility of resolution of the dispute and compromise between them, hence the pre-trial detention of applicant would not serve any fruitful purpose. He would submit that charge sheet has been filed, applicant is in jail since 19/05/2025 and the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicant on regular bail. 4. On the other hand, learned State counsel opposes the bail application and she would submit that charge sheet has been filed in this case. 3

I have heard learned counsel for the parties and perused the case diary. 6. From perusal of the records, it transpires that this is the second bail application of the applicant and the first bail application was rejected by this Court on merits vide order dated 24/07/2025 in MCRC No.4878/2025 . Only ground which has been raised in this second bail application is that applicant and complainant are well known to each other and they are neighbours, therefore there is every possibility of resolution of the dispute and compromise between them, hence the pre-trial detention of applicant would not serve any fruitful purpose. No new ground has been raised in this second bail application to entertain the same. 7. Accordingly, the second bail application of the applicant-Lekhram Chakradhari, involved in Crime No.81/2025 registered at Police Station, Kabir Nagar, Raipur (C.G.) for the offence punishable under Sections 118(1), 296, 351(2) of Bhartiya Nyay Sanhita, 2023 is rejected. 8.
