Neutral Citation No. - 2025:AHC:67334 Court No. - 6 Case :- WRIT - A No. - 5655 of 2025 Petitioner :- Shanti Devi Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Anil Kumar Pathak Counsel for Respondent :- Akhilesh Kumar Sharma,C.S.C. Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Sri Anil Kumar Pathak, learned counsel for petitioner and Sri Akhilesh Kumar Sharma, Advocate for Respondents-2 and 3.
2. Petitioner’s husband died in harness on 27.04.2008. Petitioner is getting family pension since then and now after about 17 years, she has approached this Court that other dues including gratuity, if permissible, be paid to her.
3. Learned counsel for petitioner has shown some documents to say that petitioner was agile and was filing representations for above referred prayer, however, except a recent representation dated 14.11.2024, no other document or representation is placed on record.
4. In aforesaid circumstances, it is evident that petitioner is lethargic towards her rightful claim, if any. Still considering that only due to the fact that petitioner has approached this Court at a belated stage, her rightful claim cannot be rejected, therefore, this writ petition is disposed of with liberty to petitioner to file a fresh representation, which will be considered by concerned respondent in accordance with law.
