The Court made the following Order:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondent Nos.2 and 3 in non-implementing the memo issued by the 1st respondent dated 07.03.2019 and 24.10.2019 for an extent of Ac.5.00 cents in Sy.No.58/1 situated at P.M. Palem Village Visakhapatnam (Rural) Mandal, Visakhapatnam District to delete the subject property from the prohibited list under Section 22-A (1) of the Registration Act, 1908. 3. The learned counsel for the petitioner submits that by virtue of the interim orders of this Court in this writ petition dated 17.03.2020 the respondents released the subject land from the prohibited list as per the memo of the 1st respondent dated 07.03.2019. 4. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 2nd respondent submits that the respondent officials concerned filed the Civil Suit in O.S.No.83 of 2020 on the file of XII Additional District & Sessions Judge Court, Visakhapatnam against the petitioner herein for cancellation of the Conveyance Deeds obtained by playing fraud with respect to the subject land by the petitioner herein and the same is pending. 3 HBKM,J W.P.No.6224 of 2020
5. Since the petitioner and the respondents are the parties to the above said suit proceedings, both the parties are directed to pursue the same with respect to the subject land and the memo of the Government dated 07.03.2019 is also subject to outcome of the suit proceedings. 6.
It is further observed that, subject to the outcome of the Civil Suit proceedings, both the parties i.e., the petitioner and the respondents shall act upon strictly in accordance with law with respect to the subject land. It is open for both the parties in the suit proceedings to seek appropriate interim reliefs, if so, warranted and advised before the said Civil Court. But however, there shall be an order of status quo as on today to be maintained with respect to the subject land, pending the suit proceedings. 7. Observing the same, this Writ petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
