The Court made the following ORDER:
1. This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue an appropriate Writ, order or direction more particularly one in the nature of Mandamus declaring the action of the Respondents in treating the land Sy. No. 24/1, Madhavadhara Village, Visakhapatnam (Urban) Mandal, Visakhapatnam District as surplus land under the Urban Land Ceiling Act, 1976 even though de-facto physical possession of the said land was not taken by the state and consequently including the said land in the prohibited properties list under Section 22A of the Registration Act, 1908 as being illegal, arbitrary, contrary to the provisions, particularly Section 4 of the Urban Land (Ceiling and Regulation) Act, 1999 and violative of Articles 14 and 21 of the Constitution of India and consequently direct the Respondents to delete/ de-notify the said land from the list of prohibited properties under Section 22A of the Registration Act, 1908 forthwith and pass…”
2. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondent Nos. 1 to 5. 3. The learned counsel for the petitioner submits that the petitioner made a representation dated 25.04.2025 to the respondent authorities seeking deletion of the subject land from the prohibitory list under Section 22-A of the Registration Act, 1908. Even after receipt of the said representation, the respondent authorities have neither considered the same nor passed any orders thereon. Hence the writ petition. 4.
The learned Government Pleader for Revenue appearing for the respondents submits that the respondent authorities will consider the
petitioner’s representation and pass appropriate orders thereon within a reasonable time. 5. Having regard to the submissions made by the learned counsel for the petitioner and on perusal of the material available on record, this Court is of the considered view that the present writ petition can be disposed of by directing the respondent authorities to consider the representation of the petitioner dated 25.04.2025 for deletion of the subject property from the prohibited list notified under Section 22-A of the Registration Act, 1908 as expeditiously as possible, strictly in accordance with the law, preferably within a period of two (02) months from the date of receipt of this order. It is needless to mention that the respondent authorities shall conduct a necessary inquiry by hearing all the concerned parties. 6. With the above direction the writ petition is disposed of.
