GP FOR FINANCE PLANNING The Court made the following: 3 VS,J W.P.NO.20546 OF 2024 THE HONOURABLE SMT JUSTICE V.SUJATHA WRIT PETITION NO: 20546/2024 ORDER:- This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “….to issue a writ order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in withholding the deposits payments of Rs.12,78,935/- (Rupees Twelve Lakhs Seventy-Eight Thousand Nine Hundred and Thirty-Five Only) for the works executed by the petitioner as bad, illegal, arbitrary, improper, unjust and against the Article 21 of Constitution of India and consequently direct the respondents to pay the deposits amounts of Rs.12,78,935/- (Rupees Twelve Lakhs Seventy-Eight Thousand Nine Hundred and Thirty-Five Only) payable to the petitioner for the works executed by the petitioner.” 2. The petitioner is a civil contractor who has been executing works for various Government Departments, including the R & B and Panchayat Raj Departments. The respondents entrusted certain works to the petitioner under valid agreements. The petitioner completed the said works within the stipulated contract period and strictly in accordance with the terms and conditions of the agreements. The completed works were duly recorded in the Measurement Books. However, despite satisfactory completion of the works, the respondents have withheld the deposit amounts aggregating to Rs.12,78,935/-, which are payable to the petitioner in respect of the works executed by him. 3. Heard learned counsel for the petitioner as well as learned Assistant Government Pleader for Irrigation appearing for the respondents. 4 VS,J W.P.NO.20546 OF 2024 4. The 6th respondent has filed a memo on 15.12.2025, duly admitting the fact that the petitioner has completed six lift irrigation scheme works, including the revival of Boddulurivaripalem-2 Lift Irrigation Scheme. The deposit (FSD) bill amount was paid to agency through CFMS Portal vide token No.2025-487297 for Rs.2,10,253/- on 30.09.2025. But however, with regard to the payment of other five works, it is stated that the same are to be uploaded in Nidhi Portal, and after receipt of necessary permission for release of the deposit from the APSIDC Circle Office, Guntur, process will be initiated for uploading of deposits for the remaining five works. 5. As the amount payable to the petitioner is admitted, there shall be a direction to the respondents to clear the bills, excluding the amount already paid to the petitioner to a tune of Rs.2,10,253/-, as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of copy of this order. 6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
