THE HON’BLE SRI JUSTICE HARINATH.N WRIT PETITION No.26004 OF 2025 ORDER
1. This writ petition is filed aggrieved by the action of the respondents for non-payment of the bills for the works undertaken by the petitioner. 2. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development, the learned Assistant Government Pleader for Finance and Planning, and the learned Standing Counsel for the respondent- Corporation. 3. The learned counsel for the petitioner submits that the petitioner has executed the work, viz., construction of 450 MM dia CC drain from Subramani House D.No.10-10-244 to T.S. Sekhar House D.No.10-10- 244/2 at VKS Layout street 2 in Ward No.06 in Nagari Municipality, vide agreement No.NMC/E1/Agmt.No.185/2023-24, dt.04.12.2023, as entrusted by respondents 3 and 4. 4. The learned counsel further submits that the petitioner duly executed the work within the stipulated time to the satisfaction of respondents 3 and 4. It is further submitted that after execution of the works, the 4th respondent recorded the progress of the work in M Books, final quality assessments were also done by the agency employed by the 4th respondent and thereafter the petitioner has a final bill for a sum of Rs.1,34,553/- and the same was approved by the competent authority,

but so far no payment has been made to the petitioner. The learned counsel further submits that due to non-payment of the bill, the petitioner is suffering with financial hardship. 5. In reply, the learned Standing Counsel appearing for respondents 3 and 4 submits that there is no dispute with respect to the completion of the works undertaken and the amount claimed by the petitioner and that the amount would be paid in due course. 6.
Considering the submissions, respondents 2 to 4 are hereby directed to verify and release the payments due payable to the petitioner as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of a copy of this order. 7. Accordingly, the writ petition is disposed of. No costs. 8. Pending miscellaneous petitions, if any, shall stand closed. ____________________ JUSTICE HARINATH.N BV
