1. This writ petition is filed under Article 226 of the Constitution of India, to issue Writ of Mandamus, claiming the following direction:
“To issue Writ of Mandamus declaring the action of respondents in interfering with the possession and enjoyment of the petitioners land admeasuring an extent of Ac.2.00 Cents in Sy.No.399/1, Ac.1.88 Cents in Sy.No.420/1, Ac.0.40 Cents in Sy.No.398/1, Ac.0.41 Cents in Sy.No.915/1 of Tellapadu Village, Anumasamudram Post, A.S.Peta Mandal, SPSR Nellore District, by issuing the notice dt. 10.04.2025, without jurisdiction, without following the due process of law as illegal, arbitrary, violative of Article 21 and 300-A of the Constitution of India, Consequently direct the respondents herein not to interfere with the peaceful possession and enjoyment of the petitioners land admeasuring an extent of Ac.2.00 Cents in Sy.No.399/1, Ac.1.88 Cents in Sy.No.420/1, Ac.0.40 Cents in Sy.No.398/1, Ac.0.41 Cents in Sy.No.915/1 of Tellapadu Village, Anumasamudram Post, A.S.Peta Mandal, SPSR Nellore District”

During hearing, learned counsel for the petitioners submits, the Tahsildar, Anumasamudram Peta issued Notice in Rc.B.34/2024 dated 10.04.2025 to the petitioners, directing them to appear before him for an enquiry regarding cancellation of the pattadar passbooks and title deeds issued in their favour, in respect of the subject land. The 4th respondent is proceeding unilaterally to cancel the pattdar passbooks, title deeds and threatening to dispossess the petitioners. Hence the writ petition. 3. Learned Assistant Government Pleader for Revenue submits that, the respondents would follow due process of law and requested to pass appropriate orders. 3 NV,J W.P.No.12367 of 2025

Having regard to the submissions made by learned counsel for the petitioner, learned Government Pleader for Revenue and perused the material available on record, this Court deems it appropriate to direct the petitioners to submit an explanation to the 4th respondent within a period of three (03) weeks from the date of receipt of copy of this order.
After submission of such explanation, Respondent No.4 shall consider the same and pass appropriate orders within a period of three (03) weeks thereafter. If Respondent No.4 comes to a conclusion that the petitioners are not entitled to the relief they claimed for, Respondent No.4 shall forward the matter to the competent authority for passing appropriate orders as per Section 5(2) of the The Andhra Pradesh Rights In Land And Pattadar Pass Books Act, 1971. In the meanwhile, status obtaining as on today shall be maintained by all the parties concerned with respect to the subject property. 5. With the above direction, the writ petition is disposed of at the stage of admission with the consent of both the counsel. No costs. 6.
