1. By way of the instant petition, the petitioner has prayed for the following reliefs:- 10.1 That, this Hon’ble Court may kindly be pleased to direct the respondent No.2 & 3 for ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2025.09.16 18:38:52 +0530
2 / 3 grant of compensation and condone and waive off the lease amount in favour of the petitioner while deciding the representation of the petitioner society. 10.2 That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.

The instant petition has been filed for seeking a direction towards the Respondents No.2 & 3 for grant of compensation / waive off the lease amount in favour of the petitioner society for the reason that on 14/01/2021 petitioner society got lease for the period of 10 years regarding ponds which come under the Nagar Palika Sakti, District Sakti, C.G. from the date of fish farming. On 09/08/2024 the officer of Nagar Palika Sakti and their workers removed the iron net and gate installed by the petitioner society from the gate without giving any prior notice to the petitioner society whereby all the seeds and fish foods were drained out from the said pond whereby the petitioner society faced financial loss of Lakhs of Rupees as such the petitioner is entitled for the compensation as per the Machua Niti for the loss sustained by them.

Learned counsel for the petitioner would contend that the respondent authorities may be directed to decide the representation made by the petitioner dated 01/07/2025 (Annexure P/2) within a stipulated time frame.
4. Learned State counsel submits that they have no objection in deciding the representation made by the petitioner.

5. I have heard learned counsel for the parties and perused the documents with utmost circumspection.

Considering the entire facts & circumstances of the case and the limited prayer made by learned counsel for the petitioner and no objection given by the State counsel, it is directed that Respondent No.2 i.e. the Collector Sakti, District Sakti, C.G. shall decide the representation of the petitioner dated 01/07/2025 (Annexure P/2) expeditiously as early as possible in accordance with law.
7. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the representation of the petitioner on its own merits. SD/- SD/- (Arvind Kumar Verma)
