AMARNATH GOUD ORDER 02.04.2025 Heard Mr.P.RoyBarman, learned Senior counsel assisted by Mr. K. Chakraborty, learned counsel appearing for the petitioner. Also heard Mr. BN Majumder, learned Senior counsel assisted by Mr. D.J Saha, learned counsel appearing for the respondent-contemnors. [2] The present Contempt Petition has been filed under Article 215 of the Constitution of India read with Section 12 of the Contempt of Courts Act, for drawing up contempt proceeding against the respondent-contemnors for willful and deliberate disobedience of the specific direction of this Court dated 09.01.2025 passed in I.A 02/2025 arising out of W.P.(C) No.828/2024. [3] It is seen from the record that the contempt was initially filed against the interim order and during the course of time, the main case itself has been decided in favour of the petitioner. This Court finds that there nothing survives in the contempt to adjudicate against the interim order. Accordingly, the Contempt petition is closed. [4] In view of the same, the instant Contempt Petition is closed. However, it is made clear in the event, if the petitioner is so aggrieved, it is open for the petitioner to avail remedies under law, if so advised.
