He further submits, during investigation Investigating Officer recorded the statement of one eye witness Nilesh Singh @ Gesu but surprisingly during investigation this witness has also been made accused and now charge-sheet has been filed and as he is now one of the accused, therefore, from the charge-sheet it reflects, there is no eye witness account. 6. However, applicant is named in the FIR along with others but from the FIR and the statement of the informant it reflects, he was not an eye witness. 11. Further, from the entire material available on record, it reflects, except Nilesh Singh @ Gesu no one could see the real incident but surprisingly during investigation this witness has also been made accused, therefore, there is no eye witness is left and considering the totality of facts and circumstances of the case, the argument advanced by learned counsel for the applicant that there is no cogent evidence on the basis of which it can be said that applicant committed the murder of the deceased, cannot be ruled out at this stage. 12. Further, applicant is not having any criminal history and in the present matter he is in jail since 03.01.2025. 13. Therefore, considering the facts and circumstances of the case discussed above, in my view, applicant is entitled to be released on bail. 14.
